LEY FEDERAL DE PROTECCIÓN DE DATOS PERSONALES POSESIÓN DE LOS PARTICULARES Nuestros invitados están protegidos para proporcionar su información ya que actuamos bajo la “Ley Federal para la Protección de Datos Personales” de México. La información proporcionada se utilizará solo para razones de seguridad y depósito de seguridad. No se aplicarán cargos sin la confirmación de cualquier servicio y/o verificación de cualquier infracción de las reglas de la casa. POLÍTICA DE CANCELACIÓN Las políticas de cancelación descritas a continuación son aplicables de acuerdo con las políticas de reserva directa a través de Hero Host®. La cancelación es Estricta, para la confirmación de la reserva, se deberá hacer el pago del total de la reserva, el cual no será reembolsable. Para casos de fuerza mayor por motivos de la pandemia como cierres de frontera o contagio de un integrante del viaje se otorgará un crédito para cambio de fechas con límite de un año, el cual dependerá de la disponibilidad y cambios en tarifas. Una vez ingresado el huésped no hay reembolsos bajo ninguna circunstancia por inconformidad del departamento, como situaciones climáticas, acomodo del departamento, configuración, amenidades, ruido externo, opiniones subjetivas, entre otros. Hero Host no reembolsará con base en amenazas de publicar reseñas negativas y reportará o denunciará el caso de inmediato a la plataforma y/o autoridades correspondientes. ESPECIFICACIONES DE LA RESERVA Horarios: El horario de check-in es a partir de las 3:00 p.m. y la hora de salida es antes de las 11:00 a.m. Si el huésped no deja las instalaciones a la hora mencionada se le cobrará un día extra. Concierge: El área de concierge está disponible de 7:00 a.m. a 11:00 p.m. por teléfono o vía chat y coordinará el servicio de su solicitud para atenderle. El área operativa está disponible 24/7 para emergencias. El huésped se compromete a mantener apagadas las luces, los equipos eléctricos y de aire acondicionado cuando no se estén ocupando. En caso de que no se cumpla con este punto, se le cobrara al arrendador los excedentes en consumo de energía. Los huéspedes no deben crear ruido excesivo a un nivel que moleste a los vecinos; El horario de silencio es a partir de las 10:00 p.m. hasta las 10:00 a.m. del día siguiente. En caso de existir reporte por parte de la administración se deberá pagar la multa por $1,500 mxn durante el check out. No se admiten mascotas en el establecimiento y no se permite fumar dentro del depto. (solo en áreas de terraza con cenicero). Queda estrictamente prohibido consumir, vender o tener sustancias ilegales en los alojamientos. El uso, consumo o intercambio de las mismas causará la cancelación inmediata de su reservación, se hará saber a las autoridades correspondientes. El propietario no es responsable del mal tiempo, fallos de Internet por parte de la empresa que presta el servicio o cualquier circunstancia fuera del apartamento. El inquilino deberá dejar las instalaciones y todos los muebles y electrodomésticos al final del período de alquiler en una condición tan buena como existía al comienzo del período de alquiler, exceptuando el desgaste normal. PROLONGACIÓN DE LA ESTANCIA SIN EL CONSENTIMIENTO DEL ANFITRIÓN De acuerdo con los términos y condiciones de Hero Host específicamente en la sección “Prolongación de la estancia sin el consentimiento del anfitrión”, el cliente acepta que desde el momento en que él/ella pospone su salida de la fecha y hora estipulada en el actual registro, sin autorización del anfitrión se hará el cargo correspondiente de la tarifa acordada por la estancia de una sola noche durante cada día que pase hasta que se desaloje la propiedad, y el anfitrión tendrá el derecho de iniciar las acciones legales correspondientes para expulsarlo(a) de la propiedad, y los costos de dichas acciones legales también se cargarán al huésped. Al momento de su reservación, confirmación y/o check-in, usted acepta todos nuestros Términos y Condiciones, Reglas y Políticas. CASOS FORTUITOS O DE FUERZA MAYOR Hero Host, el anfitrión, los propietarios de los alojamientos y el personal de servicio se deslindan de cualquier daño causado a la salud del huésped o a sus pertenencias por robo, extravío o causas de fuerza mayor. Así como por daños causados directamente por el cliente y/o sus invitados. Entendiéndose como fuerza mayor el evento de ruptura, enfermedad, pandemia, fallas, cortocircuitos, fugas, colapsos, incendios, desastres naturales o accidentes, dado que el cliente los asume bajo su propio riesgo, liberando a Hero Host, el anfitrión, propietario, personal de servicio de cualquier responsabilidad en cualquiera de estos casos. PROHIBICIÓN DE CEDER LOS DERECHOS DE ALOJAMIENTO El actual alojamiento es para el cliente y sus acompañantes exclusivamente. Cualquier subarrendamiento y/o transferencia parcial o total, temporal o permanentemente, gratis o con costo está prohibida. En caso de no respetar esta disposición, el cliente responderá con una penalización de $10,000 MXN (diez mil pesos mexicanos) por cada día que transcurra esta situación. COMPETENCIA JURÍDICA En caso de una demanda, los involucrados están sujetos a la competencia jurídica de las Cortes Ordinarias en la Ciudad de México y las leyes actuales del país, renunciando a otras leyes que puedan ser aplicables. Nos reservamos el derecho de admisión a cualquier persona que no cumpla con los requisitos de acceso: pago, depósito de seguridad, identificación oficial, registro con nombre completo (que coincida con el ID) de todas las personas que ingresen a la propiedad y cualquier información o término antes mencionado SANCIONES ECONÓMICAS POR DAÑO A LAS INSTALACIONES Usted como huésped declara que está consciente de la sección titulada “Daños a las instalaciones” contenida en los Términos y Condiciones de Hero Host., Airbnb, Expedia, Booking, HomeAway, VRBO, o cualquier otra plataforma por la que se haya hecho la reservación, expresando conocimiento de antemano de tales condiciones. Por lo tanto, expresa conformidad en que Hero Host., Airbnb, Expedia, Booking, HomeAway, VRBO, o cualquier otra plataforma por la que se haya hecho la reservación hará el cargo a su tarjeta o lo cobrará de su depósito en caso de que la propiedad donde se hospeda sufra cualquier clase de daños causados por el huésped, o una persona hospedándose en la propiedad o cualquier otra persona a la que se le haya autorizado el acceso a la propiedad, después de recibir evidencia que pruebe dichos daños. El anfitrión se reserva el derecho de inspeccionar la propiedad donde el huésped se está hospedando, personalmente o a través de terceros designados, durante horas hábiles y por la totalidad de la estancia acordada. En la medida permitida por la ley, el Inquilino acepta indemnizar, eximir de responsabilidad y defender al Propietario y a sus agentes de y contra todas y cada una de las pérdidas, reclamaciones, responsabilidades y gastos, incluidos los honorarios razonables del abogado, que el Propietario puede sufrir o incurrir en relación con la posesión, uso o mal uso de la propiedad por parte del inquilino.
